…a short course in representation and fees…
BUYER REPRESENTATION … We can represent you with your purchase of real estate anywhere in Oregon under a Buyers Service Agreement whereby you actually become our client rather than just being a customer … which is the case in many situations. With you as our client, we gain access to more real estate offerings other than those published in the local MLS system; and we can negotiate on your behalf from a stronger position thereby improving your competitive edge. And we can represent you with the purchase of any type of property from residential to ranches to your next investment property. As with most situations, the sooner you put us on your team, the more valuable our services become.
SELLER REPRESENTATION… This is the traditional method of the real estate broker representing a property owner in the sale or leasing of their property through a “listing” or more correctly, a Brokers Employment Agreement. We provide the marketing services to maximize the exposure of your property to as many brokers and members of the public as possible through the MLS, advertising, internet, flyers, signage, and our professional & personal networking contacts. As your representative, we work hard every day to provide valuable benefits … achieving the maximum price for your property in the most timely manner while always striving to make the process convenient and secure for you and your family.
CONSULTING… Not all real estate issues fall into a neat buying or selling scenario. Sometimes you just need to know more about your property in order to make it more attractive, more versatile, more valuable, or more profitable. Sometimes Oregon’s land use laws will overwhelm you with their complexity and impacts on your property. Sometimes you might just need an update on market conditions or what your local government jurisdictions are doing that may affect your community and your property. In these cases, we are available on an hourly or task basis to assist you in making the right decisions. We do our best to know the market, the laws and financing options; but we must remind you that we are not attorneys or accountants and therefore cannot provide legal or accounting advice. In fact we will encourage communication with your CPA, attorney, and other technical experts whenever needed as members of your professional team.
MEDIATION SERVICES… Brian has been privately trained as well as being a National Association of Realtors mediator since 2000. He limits his mediation services to real estate, construction, land use, development and estate management situations where his understanding of those businesses allows him to be most effective. Mediation is usually the last chance that the parties have to reach an agreement themselves: When they move on to arbitration or litigation, the arbitrator, judge or jury makes the decision; and at that point you lose control and the “game” gets more expensive. All involved parties must simply agree to come to the table. Mediation services can also be arranged on an hourly or task basis depending upon the circumstances of the case.
FLEXIBLE FEE STRUCTURES … Compensation for real estate services is fully negotiable, and there will always be those that want to charge more or discount deeper to win a client. In the end you will usually get what you pay for, and we believe our experience, education, and Oregon market knowledge put us above the competition in terms of maximizing the value of your dollar. We offer several options when it comes to commissions depending upon the situation and your needs …
Percentage of sales price … this is the conventional fee structure whereby we, as your broker, would receive a percentage of the sales price when the property sells.
Hourly rate … whether for short term consulting, long term advice, mediation services, or many other situations, we can simply be paid an hourly rate for our advice and services.
Flat rate … in some situations an initial retainer and/or a fixed fee works best with consulting, mediation services, or when you have a specific real estate task that needs to be handled in a specific manner.
Combination … sometimes the most fair compensation package is a combination of the above.

Oregon State Law requires that you execute a Disclosed Limited Agency Agreement for Buyers or a Disclosed Limited Agency Agreement for Sellers form prior to engaging any broker in a real estate transaction, and the law also requires that you be provided with a copy of Oregon Real Estate Agency Disclosure Pamphlet. We will be happy to provide you with a copy of these forms and answer any questions you many have regarding your rights to be represented in Oregon.
